AutoAvatar AI, Inc. and its subsidiaries and affiliates under common ownership and control (collectively, “AutoAvatar,” “we,” “us,” or “our”) respect your privacy and the information you have entrusted to us. This Privacy Policy describes how we collect, use, and disclose information when you visit autoavatarai.com and any related pages, products, services, and content (collectively, the “Services”).

The Services are intended for automotive dealerships, dealership groups, and OEM partners (“Dealership Customers”), the salespeople whose likeness and voice are used to create AI video avatars (“Talent”), and visitors to our website (“Visitors”). This Policy applies to all of the above. If you are a dealership shopper interacting with an AutoAvatar-powered experience on a dealership website, the dealership operating that site is the controller of your data; please review its privacy policy for information about how it uses your data.

To the extent state consumer privacy laws apply to us or to a specific interaction, we will honor rights granted by those laws. Any reference to a specific state law below is informational; the rights described may or may not apply to a given individual, and we may not be required to honor every request. If we honor a request that we are not required to honor, doing so does not obligate us to honor other requests.

Notice of Collection

The purpose of this Notice of Collection is to describe the categories of personal information AutoAvatar collects and the purposes for which we use it.

We may process the following categories of personal information:

  • Identifiers such as name, work email, business phone number, IP address, cookies, pixel tags, and similar identifiers submitted through our contact form or collected automatically when you use our website.
  • Professional / Employment such as job title, role at the dealership, dealership name, dealership group, and similar business context you provide when requesting a demo or contacting us.
  • Commercial such as the plans or services you inquire about, demo history, and account status.
  • Audio / Video / Visual / Electronic such as Talent capture footage (voice recordings, video recordings, photographs, and derived biometric-style vectors used to generate an AI video avatar) collected during a Talent capture session, and recordings of support or sales calls where permitted by law.
  • Internet Activity such as pages viewed, referring URL, device and browser information, and interactions with our website, marketing emails, and advertisements.
  • Geolocation Data (non-precise) such as approximate location derived from IP address for analytics and fraud prevention.
  • Customer Records such as billing contact, purchase order details, and, for paid customers, limited payment metadata handled by our payment processor (we do not store full card numbers on our servers).
  • Inferences such as buyer-fit signals about a Dealership Customer (for example, likely plan interest) derived from the information above.

Some categories are considered “sensitive” under various state laws. Our collection of sensitive categories is limited:

  • Biometric-style data for AI avatar creation — voice prints, facial geometry, and similar features derived from Talent capture footage. Collected only with the Talent’s written consent and only for the purpose of generating and maintaining that Talent’s AI video avatar. Not sold. Not shared with third parties for their own purposes.
  • Government-issued ID numbers — collected only where required, for example to verify Talent identity or to comply with employment or tax rules for contractors. Not sold. Not shared for marketing purposes.
  • Account or payment card information combined with a security code — handled by our payment processor for paid customers; not stored in full by us.
  • Precise geolocation, genetic data, sexual orientation, health information, citizenship or immigration status, race, ethnicity, religion, philosophical beliefs, union membership, personal data of a child — we do not intentionally collect these categories through the Services.

Purposes of Use

We use the categories of personal information listed above for one or more of the following purposes:

  • Providing the Services — creating, training, hosting, and delivering AI video avatars; generating avatar responses to end-user questions on dealership properties; delivering analytics and reporting to Dealership Customers.
  • Customer Service & Account Management — responding to demo requests and inquiries, provisioning accounts, providing customer support, and maintaining the Services.
  • Advertising & Marketing — sending marketing communications relating to AutoAvatar features, releases, and events to business contacts who have expressed interest.
  • Website Analytics & Product Improvement — auditing interactions with our website and marketing, measuring engagement, and improving the Services and avatar quality.
  • Fraud Prevention & Security — detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and enforcing our terms.
  • Legal Compliance & Defense of Claims — complying with applicable law, responding to lawful requests, and defending against or asserting legal claims.

Categories of Sources

We collect personal information from the following categories of sources:

  • Directly from you through our contact and demo request forms, sales conversations, and Talent capture sessions.
  • Dealership Customers that provide business contacts, Talent lists, and integration configuration.
  • Analytics & advertising providers such as Google Analytics and similar tools that measure how visitors interact with our website.
  • Security & anti-abuse providers such as reCAPTCHA, which helps us distinguish legitimate form submissions from automated abuse.
  • Service providers such as email delivery, hosting, database, customer support, and payment processors acting on our behalf.
  • Government and public sources where required for verification or legal compliance.

Categories of Third Parties We Disclose Personal Information To

AutoAvatar does not sell personal information for monetary consideration. In the last twelve (12) months, we have disclosed the categories of personal information described above to the following categories of recipients for the business purposes described in this Policy:

  • Service providers acting on our behalf (hosting, database, email, analytics, security, payment processing).
  • Dealership Customers, with respect to Talent avatars and conversations occurring on that Dealership Customer’s properties.
  • Professional advisors, such as auditors and attorneys, under obligations of confidentiality.
  • Government authorities and other parties as required by law or to protect our rights.
  • A successor entity in the event of a merger, acquisition, financing, or sale of assets.

“Sale” and “share” are defined broadly under some state laws. To the extent our use of analytics and advertising cookies on our website constitutes “sharing” for cross-context behavioral advertising under those laws, you may opt out as described in the “Your Choices” section below.

Retention

We retain personal information for as long as needed to provide the Services, to comply with legal obligations, to resolve disputes, and to enforce our agreements. Talent biometric-style data used to power an AI video avatar is retained for as long as the Talent’s avatar is active and is deleted or de-identified within a commercially reasonable period after the Talent or the associated Dealership Customer requests deactivation, subject to legal retention requirements.

Your Choices and Rights

Depending on where you live, you may have the following rights with respect to personal information we hold about you:

  • Right to know what personal information we collect, use, disclose, and (if applicable) “sell” or “share.”
  • Right to access a copy of personal information we hold about you.
  • Right to correct inaccurate personal information.
  • Right to delete personal information, subject to legal exceptions.
  • Right to opt out of “sale” or “sharing” of personal information for cross-context behavioral advertising.
  • Right to limit use of sensitive personal information to purposes necessary to provide the Services.
  • Right to non-discrimination for exercising these rights.

Talent (Sales Avatar Subject) Rights

If you are a salesperson whose likeness, voice, and performance have been captured to create an AI video avatar, you have the following additional rights, regardless of your state of residence:

  • Written consent is required before we capture your likeness or generate your avatar.
  • You may request deactivation of your avatar at any time. We will disable the avatar within a commercially reasonable period and delete or de-identify the underlying biometric-style data, subject to legal retention obligations.
  • You may review the categories of scripts and topics your avatar has been authorized to speak to.
  • You may request a copy of the raw capture footage we hold about you.

Section 2 — Other Important Privacy Disclosures

Children

The Services are directed to businesses. We do not knowingly collect personal information from children under 16. If you believe we have collected information from a child, contact us via the Contact page and we will delete it.

Cookies, Analytics & Similar Technologies

Our website uses first-party and third-party cookies, pixels, and similar technologies to operate the site, remember your preferences, understand how visitors interact with our content, and measure the effectiveness of our marketing. We currently use Google Analytics 4 for website analytics and Google reCAPTCHA to protect our forms from automated abuse. Most browsers let you refuse or delete cookies; doing so may affect website functionality.

Do Not Track

AutoAvatar is not a financial institution and does not extend credit or arrange financing for vehicle purchases. Any credit application, financing decision, or payment processed on a dealership site is subject to that dealership’s privacy practices and applicable federal law, including the Gramm-Leach-Bliley Act and the Fair Credit Reporting Act.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last Updated” date at the top of this page. Material changes will be communicated through the Services or by other reasonable means.
